Scandal in the reconstruction of Okhmatdyt. A company worth 307 million with doubled prices was chosen as the contractor without explanation.
Charitable Organization ‘Okhmatdyt Foundation’ selected LLC “Bud-Technology” as the winner of the tender for the repair of the hospital building damaged by a rocket attack in July, according to the Okhmatdyt National Children’s Specialized Hospital’s Facebook post on July 31.
Out of 14 participants in the competition, this was the third most expensive offer, totaling 307 million UAH (excluding VAT). A dozen other participants offered to complete the work at significantly lower prices—ranging from 42 to 286 million UAH. However, the client did not engage in negotiations with any of them, providing no explanation for the decision.
Analysis by ‘Nashi groshi’ revealed that out of the ten lower-priced proposals, at least seven included fully completed commercial offers specifying prices for various types of work.
‘Okhmatdyt’ emphasized that the ‘competitive selection conducted is not a tender within the meaning of the Law of Ukraine “On Public Procurement,” but rather a private competition organized for the purpose of transparent and fair use of funds donated by citizens.
However, ‘Okhmatdyt’ did not provide any explanation for ignoring the lower-priced proposals. The head of the charitable foundation ‘Okhmatdyt-Healthy Childhood’ is Yevhen Vember, with Svitlana Rozborska serving as chief accountant.
According to Nashi Groshi, the finalists included “DAK” (310 million UAH) from the “Altis” group of Oleksandr Hlymbovsky, “Bud-Technology” (307 million UAH) from the Sensar group of Zaporizhzhia developer Mark Marchenko, and “Mega Profit Group” (220 million UAH) of Oleksiy Lomakina and Yulia Kuzmenko.
The client’s working group held online meetings with these firms. ‘Mega Profit Group’ was rejected due to unknown suspicions about its tax documents. ‘DAK’ was dismissed due to the scandalous reputation of Hlymbovsky. In July, Hlymbovsky was detained in connection with a NABU corruption case involving his son-in-law Roman Nasirov, who headed the tax authority in 2015-2016.
The client entrusted “Capital Legal Foundation” to conduct a “legal analysis of the winner regarding integrity,” and ultimately selected “Bud-Technology” as the contractor.
At the same time, the client, for unknown reasons, ignored the following issues in the winning proposal. For example, “Bud-Technology” only listed the rental of construction equipment: a ‘Kamaz’ crane, a MAN with a manipulator, and a JCB excavator. None of these machines can be used for facade installation above the second floor. Additionally, the firm did not provide any data on equipment for tile installation.
Inflated prices of the winner and work volumes from the client
The largest expense items for the winner were the repair of facade composite panels ‘Reynaers’ (the large dark panels in the photo of the building) and the interior wall finishing with HR-panels. Each of these items in “Bud-Technology” costs over 100 million UAH. Meanwhile, the price of these works is twice as high compared to the cheaper participants in the competition (see comparative table).
Additionally, the company “Riola-Module,” which had originally carried out the construction of the building, stated in its tender proposal (179 million UAH) that after the rocket strike, it had already completed the repair of so-called ‘clean rooms’ (such as operating rooms) free of charge. Wall and ceiling structures had already been partially replaced, and damaged linoleum had been addressed. This suggested that the scope of repair work funded by donors might already be inflated.
What is known about the selected contractor “Bud-Technology”
LLC “Bud-Technology,” with a statutory capital of 5,000 UAH, is registered in Zaporizhzhia. It has not participated in state tenders. As evidence of experience in similar work, the firm submitted a subcontract agreement with LLC “Kram-Invest” for construction work on a clinic in Zaporizhzhia at 27 St. Nicholas Street. Public information about the construction of the Zaporizhzhia clinic ‘UniClinic’ indicates that it was implemented by the Zaporizhzhia development company Sensar, led by Mark Marchenko.
Today, the owner and manager of “Bud-Technology” is Vasyl Kobyz, who is registered in the village of Bratske, Zaporizhzhia Region. According to “NGL.media,” the previous manager was Olha Shalenna, who is the mother of Yevhen Shalenny, a longtime partner of Mark Marchenko. “Zaporizhzhia Center for Investigations” refers to Yevhen Shalenny as “Marchenko’s manager.”
Mark Marchenko and Yevhen Shalenny developed the local branch of the “Self-Reliance” party in Zaporizhzhia starting in 2015, led by Lviv Mayor Andriy Sadovyi. At that time, Marchenko’s business partner was the brother of the deputy mayor of Zaporizhzhia. In 2017, Marchenko was detained over fictitious acts of completed works on construction projects in Zaporizhzhia and Melitopol totaling 87 million UAH. “Self-Reliance” publicly defended the businessman, calling the case ‘pressure on the political force.’ In 2022, it was revealed that “Bud-Technology” and Sensar owned land in the green suburbs of Lviv, supposedly for the construction of a rehabilitation center for ATO veterans. However, it turned out that 99% of the development area was intended for a shopping and entertainment center.
In the latest local elections before the invasion, Shalenny, along with Sensar Development Director Olena Bartul, ran from the ‘Servant of the People’ party.
